MJ Beach Co. Rental Agreement

This Rental Agreement (“Agreement”) is entered into between MJ Beach Company LLC (“MJ Beach Co.,” “we,” “us,” or “our”) and the customer placing an order (“Customer,” “you,” or “your”). By completing a booking or purchase, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Rental Services

MJ Beach Co. provides beach equipment rentals, including but not limited to chairs, umbrellas, cabanas, coolers, wagons, games, and accessories (“Equipment”). All rentals are delivery only to approved service areas on Chincoteague and Assateague Islands.

2. Agreement to Terms

By placing an order and checking the Terms & Conditions box at checkout, you provide your electronic acceptance of this Agreement, which is legally binding.

3. Rental Period

• The rental period begins at the scheduled delivery time and ends at the scheduled pickup time on the agreed date.

• Late returns or unauthorized relocation may result in additional fees.

4. Delivery & Setup

MJ Beach Co. will deliver and set up equipment at the location specified in your order.

Customer is responsible for:

• Providing accurate delivery information

• Ensuring the location is accessible and permitted for setup

MJ Beach Co. is not responsible for delays caused by weather, beach closures, restricted access, or incorrect information provided by the Customer.

5. Use of Equipment

Customer agrees to:

• Use all equipment in a safe and reasonable manner

• Supervise children at all times

• Follow any safety instructions provided

Equipment is intended for recreational use only.

6. Responsibility for Loss or Damage

Customer assumes full responsibility for equipment during the rental period.

You agree to be financially responsible for:

• Lost or stolen items

• Damage beyond normal wear and tear

• Excessive cleaning required due to misuse

Repair or replacement costs will be charged to the payment method on file.

7. Weather Policy

Beach conditions and weather are beyond our control.

If severe weather prevents setup or requires early pickup, MJ Beach Co. may:

• Reschedule your rental, or

• Provide a partial or full credit at our discretion

No refunds are guaranteed once equipment has been delivered and set up.

8. Cancellations

• Cancellations made 12 hours before delivery may receive a full refund or credit.

• Cancellations made after this window may not be eligible for a refund.

9. Assumption of Risk & Liability Waiver

Use of beach equipment involves inherent risks, including but not limited to injury from wind, sand, sun exposure, and normal recreational activity.

By renting equipment, you agree that:

• You voluntarily assume all risks associated with use

• MJ Beach Co. shall not be liable for injuries, accidents, or damages arising from use of rented equipment

• You release and hold harmless MJ Beach Co., its owners, employees, and agents from any claims or liabilities

10. Indemnification

Customer agrees to indemnify and hold harmless MJ Beach Co. from any claims, damages, or expenses arising from Customer’s use or misuse of the equipment.

11. Property Conditions

Customer agrees not to leave equipment unattended overnight unless part of a multi-day rental. MJ Beach Co. reserves the right to retrieve equipment if conditions become unsafe.

12. Payment Authorization

By completing checkout, you authorize MJ Beach Co. to charge the payment method on file for:

• Rental fees

• Damage or replacement costs

• Applicable taxes and fees

13. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

14. Entire Agreement

This Agreement constitutes the entire agreement between Customer and MJ Beach Co. and supersedes any prior communications or understandings.
